Effective
for tax year 2005, the Annual Report, Form CAR-100, New Jersey is
mandating the Form CAR-100 be filed and paid electronically by all
business entities including but not limited to corporations, limited
liability companies, limited liability partnerships and limited
partnerships. The paper Form CAR-100 will be eliminated and the
Annual Report will no longer be a part of the CBT-100 and CBT-100S
tax returns. The choices of electronic payment options are
electronic funds transfer, electronic check and credit card. New
Jersey advises there is no convenience fee for use of credit cards.
The New Jersey Annual report fee is $50 for corporations, limited
liability companies, limited liability partnerships and limited
partnerships.
Beginning
with the 2005 reporting period, the annual report due date may
change for most businesses subject to the corporation business tax.
Since the annual report filing is no longer coupled with the
corporation business tax filing, the basis of the reporting period
becomes the month of formation. The annual report for corporations
is due at the beginning of the period instead of the end of the
period. This change will result in some business entities being
required during the conversion year to submit two annual report and
payments within a 12 month period. For example, a corporation with a
January to December fiscal period with a formation month in January
would be required to electronically file for both 2005 and 2006 on
January 31, 2006.
This
change will not affect limited liability companies, limited
liability partnerships and limited partnerships because these
businesses entities are currently using the formation date for
annual report filing purposes.

filing of the CAR-100 and payment of the annual report fee are made
